TERMS AND CONDITIONS
1. Scope

These Terms and Conditions apply to all visits, offers, sales, and agreements between Autohandel Vandecnocke Stefaan BV (hereinafter referred to as “the Seller”) and the customer (hereinafter referred to as “the Buyer”).

2. Products and Services

The Seller specializes in the sale of vehicles and related services. All vehicle descriptions, specifications, and prices are provided in good faith and subject to availability.

3. Prices

All prices are stated in euros unless otherwise specified. Prices may include or exclude VAT, as indicated. The Seller reserves the right to modify prices at any time prior to the conclusion of a contract.

4. Orders and Payment

A sale is considered final only after written confirmation by the Seller and receipt of the agreed payment. Accepted payment methods will be communicated to the Buyer during the transaction process.

5. Delivery and Transfer of Risk

Vehicles may be collected at the Seller’s premises or delivered by arrangement. Ownership and risk are transferred to the Buyer at the moment the vehicle is handed over.

6. Liability

The Seller shall not be held liable for indirect damages, loss of profit, or consequential damages resulting from the use of the vehicle, except where mandatory law provides otherwise.

7. Applicable Law

All agreements are governed exclusively by Belgian law. Any disputes shall fall under the jurisdiction of the competent courts of Belgium.

CANCELLATION & WITHDRAWAL POLICY
1. Right of Withdrawal

In accordance with EU and Belgian consumer protection legislation, private consumers purchasing at a distance may withdraw from the contract within 14 calendar days from the date of delivery, provided the purchase qualifies as a distance sale.

2. Exercise of the Right of Withdrawal

To exercise the right of withdrawal, the Buyer must notify the Seller in writing (by email or other durable medium) before the expiration of the 14-day period, clearly stating the intention to cancel the purchase.

3. Return Conditions

The vehicle must be returned in the same condition as delivered, allowing only normal inspection. Any excessive use, damage, or depreciation may result in a deduction from the refund.

4. Costs

Return transport costs are borne by the Buyer unless otherwise agreed in writing.

5. Exceptions

The right of withdrawal does not apply to purchases made on-site at the Seller’s premises or to business-to-business (B2B) transactions, unless otherwise agreed.
